Regulations for organizing events in Zagrywki

valid from July 10, 2023.

GENERAL REGULATIONS

1 The Regulations specify the terms and conditions for the provision of the service consisting in organizing an event in Zagrywki (Regulations) for the Administrator’s clients.

2 The administrator is ABSOLUT sp. z o.o. with its registered office in Wrocław at ul. Śliczna 7/16, 50-566 Wrocław, tel. 71 77 33331, registered in the National Court Register in the register of entrepreneurs, under KRS number 0000794136, entered in the REGON register under number 383921453, with NIP number 8992865723 (“Administrator”).

3 The customer may be both a natural person who is a consumer within the meaning of the law, as well as a natural person conducting business activity or a legal person.

4 The regulations of the place define the rules for people using Zagrywki. The content is available at URL: https://zagrywki.pl/regulamin/ and on site. All persons using Zagrywki are obliged to comply with it.

6 Force majeure is understood as an event of an accidental or natural (natural) nature, the occurrence of which the Administrator has no control over, in particular fire, explosion, power failure, earthquake, flood, cloudburst, riots, pandemic, sanitary restrictions imposed by the government actions of civil or military authorities, war, acts of terrorism (including cyberterrorism), cyberattacks (e.g. DDOS), actions and/or omissions of ICT network operators.

RESERVATIONS

7 The event can be booked electronically. The customer specifies the date, number of guests, activities, method of payment. The booking summary is included in the event scenario, which is sent for the Customer’s approval. Making the payment constitutes the Customer’s confirmation of the conditions contained in the event scenario and acceptance of the Regulations, and thus confirms the booking of the event by the Administrator.

8 The date of the event binding for the Customer and the Administrator (Parties) is the date specified in the invoice/in the scenario of the event. The settlement is based on the selected attractions and the declared number of people. The exception is to increase the number of people on the day of the event (if space allows).

PAYMENT

9 The payment may be made electronically using PayU S.A. with its registered office in Poznań, 60-166 Poznań, at ul. Grunwaldzka 186, entered into the Register of Entrepreneurs kept by the District Court Poznań – Nowe Miasto and Wilda in Poznań, 8th Commercial Division of the National Court Register under the number 0000274399, with the NIP number: 779-23-08-495, with a share capital of PLN 4,944,000 PLN 0.00 paid in full, a domestic payment institution within the meaning of the Act of August 19, 2011 on payment services, entered into the payment services register under number IP1/2012 (PayU). Supervision over PayU’s activity in the field of payment services is exercised by the Polish Financial Supervision Authority. Alternatively, payment can be made by bank transfer based on an invoice.

10 The payment link is active for a certain period of time. Failure to make a payment within the validity period of the link or within the period specified in the invoice, respectively, results in the cancellation of the reservation, unless the Customer and the Administrator agree otherwise.

CANCELLATION/ TRANSFER OF THE RESERVATION

11 The Administrator stipulates that in the event of force majeure, he has the right to propose a change of date, conditions or cancel the reservation and return the funds within 180 days.

12 The customer cannot cancel the reservation. Based on Article. 38 point 12 of the Act on consumer rights of 30 May 2014, the consumer is not entitled to withdraw from a distance contract, because this right is not vested in the consumer in relation to contracts for services related to leisure, entertainment or sports events, if the contract indicates a day or service period.

13 The Customer may not change the date of the confirmed reservation, unless the Parties agree otherwise.

OPEN BAR

14 If a selected item is unavailable in the open bar package, the Administrator has the right to provide a replacement.

15 No alcohol is issued on bottles in the last hour of the open bar.

16 Regardless of when a group of guests comes, the open bar is available during the hours specified in the event template.

17 The first person to come to collect the wristbands entitling them to use the open bar is obliged to distribute them within the group.

18 The wristband must not be given to persons outside the event. The administrator has the right not to serve such a person.

19 It is possible to increase the number of people on the day of the event after the Administrator’s approval.

20 Payment for additional people and attractions is made on site.

COMPLAINTS

21 Complaints should be submitted electronically to the following e-mail address: info@wro.zagrywki.pl.

22 In the notification, please provide a possibly precise description of the irregularity (taking into account, for example, the time and place of occurrence and, if necessary,actual indication of how to resolve the complaint).

23 The complaint is considered as soon as possible, not longer than 14 days.

24 The date of lodging a complaint shall be the date of receipt of the complaint by the Administrator.

FURTHER PROVISIONS

25 The Customer undertakes to cover damages and damages caused by the Customer’s guests during the event at the premises of Zagrywki. Possible damages will be estimated by the Administrator on the basis of the damage report. The customer is obliged to cover the costs of removing the damage and destruction in the amount indicated on the relevant invoice, determined on the basis of the valuation indicated in the above-mentioned report.

26 In matters not covered by the Regulations, the relevant provisions of Polish law and/or the provisions applicable to the place of residence of the consumer law or the terms of the contract concluded between the Parties shall apply.

27 In the event of a change and/or annulment as a result of a final court decision, any of the provisions of the Regulations, the remaining provisions thereof shall remain in force.

28 The controller declares its readiness to settle disputes in an amicable manner, including pursuing claims in the out-of-court ADR (Alternative Dispute Resolution) mode. 29 Any disputes between the Administrator and a Customer who is not a consumer will be resolved by the court competent for the registered office of the Administrator.
