Venue Terms & Conditions

1. These Terms and Conditions (hereinafter referred to as the "Terms and Conditions") govern the rules of using the activity bar called Zagrywki (hereinafter referred to as "Zagrywki"), located in Wrocław, at Piłsudzkiego 69/73 Street, 50-019 Wrocław, https://zagrywki/wroclaw/kontakt/, e-mail: [email protected].  
   
   
2. The games are managed by ABSOLUT sp. z o.o. with its registered office in Wrocław at 7/16 Śliczna Street, 50-566 Wrocław, tel. 71 77 33331, registered in the National Court Register in the register of entrepreneurs, under KRS number 0000794136, entered in the REGON register under number 383921453, with NIP number 8992865723, hereinafter referred to as the Organizer. 
   
   
3. All persons using the Games (hereinafter referred to as "Users") are obliged to read these Terms and Conditions. Entering the area of the Games is tantamount to the acceptance of the Terms and Conditions by the User.  
   
   
4. The condition for using the activities located in Zagrywki is to have a valid entrance ticket (types and price list of tickets are available at the ticket offices and on the www.zagrywki.pl website).  
   
   
5. The User acknowledges that during their stay in Zagryweki, it is imperative to follow the recommendations of the staff.  
   
   
6. Staying in the area of Zagryweki may be associated with the need to comply with the provisions of other regulations, the content of which the User is obliged to familiarize himself with. The regulations referred to in the previous sentence concern:  
   
   a) event organisation;  
   b) use of the cloakroom;
   c) organization of birthdays for children; 
   d) Bacardi Martini ; 
   e) gift card.  
   

7. In the area of Zagryweki it is prohibited to: 

a) consuming food and drinks purchased outside the area of Zagryweki, 
b) bringing and using narcotic or psychotropic substances, 
c) bringing weapons and explosives, pyrotechnics, or other items that threaten the safety of Users,  
d) access to premises marked as business premises, 
e) aggressive, provocative or otherwise posing a threat to other Users.  

8. Users are obliged to show the security employee the contents of clothing and luggage brought to the Games. 
   
   
9. In the area of Zagryweki, the image is recorded using CCTV cameras. The image is recorded to ensure the safety of people staying in the area of Zagryweki while maintaining the inviolability of their personal rights. Detailed information can be found in the Privacy Policy. It is prohibited to stream, record live coverage and any other for commercial purposes without the prior consent of the marketer. In the case of recording for personal use, this is allowed provided that there is no violation of the law or good morals. The staff of the Games has the right to reprimand or ask a person who records or streams contrary to the Terms and Conditions. 
   
   
10. Persons staying in the area of Zagrywki agree to the free use and dissemination of their image, registered during their stay in Zagrywki for the Organizer's marketing purposes. The consent is granted for an indefinite period of time and without territorial restrictions for the Organizer and is granted in the scope of all known fields of exploitation, including in particular the use and exploitation on the Internet, including on social networks, such as Facebook, Instagram, public reproduction and sharing, recording, reproduction and publication in any form and technique, including copies of leaflets,  posters, etc. The Organizer ensures that the image of the Users will not be used in a ridiculous, unworthy, scandalous, compromising or defamatory manner, as well as for the purpose of promoting violence, hatred, discrimination, pornography or drugs. By accepting these Terms and Conditions, Users waive the right to verify and/or accept materials containing their image/ 
    
    

Age 

11. From 6:00 p.m., only adults can stay in Zagryweki. 
    
    
12. The Organizer reserves the right to verify the User's age on the basis of a document confirming identity. The organizer points out that it does not verify age on the basis of: student ID, school ID, scan of documents, photos of documents, screenshots of documents, health cards on the phone, consent from a legal guardian, covid passport, etc. Accepted documents are: ID card, passport, driver's license, mObywatel, sailing card, residence card, resident card. Failure to meet the above requirements may result in not being allowed to leave or asking for tickets to be released at the User's risk and expense. In such a case, the Organizer does not reimburse the User for the cost of tickets. 
    
    
13. For Beer Pong activities, age is verified on the basis of an identity document. Minors are not allowed to buy alcohol. 
    
    
14. Subject to paragraph 11, children up to and including 13 years of age may use the activities in Zagrywki only under the supervision of an adult who must stay in the area of Zagryweki.  
    
    

Liability  

15. The organizer does not provide care for children and young people. 
    
    
16. The Organizer is not responsible for damage or damage to items belonging to persons staying in the area of Zagryweki, except for damages caused by the Organizer's fault.  
    
    
17. The Organizer does not bear any material responsibility for things lost or left in Zagrywki as well as in their surroundings. Items lost or left in the Games, if they are found by an employee of the Organizer or handed over by a third party to the reception, can be picked up at the reception of the Games, within 7 working days. 
    
    
18. Persons use the activities in Zagrywki at their own risk. The Organizer does not bear any responsibility for damages of participants, including injuries, bodily injuries and their consequences, except for damages caused by the Organizer's fault. 
    
     
19. In particular, the Organizer is not responsible for any damages resulting from the use of the Zagryweki infrastructure in an improper manner, contrary to the indications and instructions of the staff or solely the fault of the person using the activity.  
    
    
20. The Organizer's employees have the option of asking or denying entry to the area of the Games, the person whose behavior threatens their safety or the safety of other persons in the Games. 
    
    
21. In the case of a large number of people on the premises, the Organizer's employees may admit people who have a valid reservation in the first place. Users who have not been allowed to enter the area of Zagryweki in the situation referred to in the previous sentence are not entitled to any claims in this regard.   
    
    

Ticket sales  

22. The Organizer sells online tickets for the Games on the www.zagrywki.pl website, through which website users place an order. It is also possible to purchase tickets on the basis of a separately concluded agreement or event regulations. These Terms and Conditions constitute, in the scope of services provided by electronic means consisting in the sale of tickets, the regulations for the provision of services by electronic means, referred to in Article 8(1)(1) of the Act of 18 July 2002 on the provision of services by electronic means. 
    
    
23. The functionality of the www.zagrywki.pl website enabling the purchase of tickets is an electronic service that is voluntary, one-time and the agreement for its provision is concluded at the moment of commencement of filling in the relevant form, and is terminated at the moment of sending the order confirmation referred to in paragraph 29 of these Terms and Conditions or resignation from filling in the form.    
    
    
24. The person ordering the ticket and paying the fee buys the right to use the activity in Zagrywki on the date specified in the ticket. The Organizer does not extend the duration of the activity in the event of the User's being late, regardless of the reason for the delay. The Organizer reserves the right to refuse to allow the User to participate in the activity if the delay prevents the User from taking advantage of the activity at the time specified on the ticket.  
    
    
25. When placing an order via the website, the user is obliged to choose the date and time of entry, the type and number of tickets, the method of payment for tickets, as well as read and accept the terms of the Terms and Conditions, which is a condition for the execution of the order.  
    
    
26. After placing an order, the user receives an e-mail message that the order has arrived in the System (ORDER CONFIRMATION).  
    
    
27. The purchase price of the ticket is binding for the organizer and the buyer according to the moment of placing an order for the purchase of a given ticket by the buyer.  
    
    
28. The organizer reserves the right to change: ticket prices, types of tickets. The above right does not affect the performance of concluded contracts and orders placed before the date of entry into force of such changes.  
    
    
29. One person can purchase any number of available tickets for the use of activities in Zagrywki on sale at a time.  
    
    
30. It is not possible to increase the number of tickets purchased unless the Organizer decides otherwise. The maximum number of additional tickets after the Organizer's consent is: 2.  
    
    
31. The Organizer is not responsible for the failure to place an order or provide an order confirmation, the inability to pay the price caused by an incorrect or inaccurate address provided by the Client, problems with the Internet or other circumstances beyond the control of the Organizer.  

Pursuant to Article 38(12) of the Act on Consumer Rights of 30 May 2014, the buyer of an admission ticket does not have the right to withdraw from a distance contract, as this right is not available to the consumer in relation to contracts for services related to leisure, entertainment or sporting events, if the contract specifies the day or period of the service provision. 

33. Complaints regarding electronic payments are handled by the PayU service. The user sends the complaint to the correspondence address of Zagrywek, which forwards it to the PayU service. The complaint should contain the following information: name and surname, date, number and amount of the transaction. PayU undertakes to provide full and comprehensive complaint service.  
    
    
34. In cases other than those listed in point 33, complaints are considered by the Organizer within 14 days from the date of receipt of the application to the Organizer's correspondence address.  
    
    
35. Settlements of credit card and e-transfer transactions are carried out via PayU.  
    
    
36. The Organizer issues and sends electronic invoices, guaranteeing the authenticity of their origin and the integrity of their content. An electronic invoice, in accordance with the Act of 11 March 2004 on the Tax on Goods and Services (Journal of Laws of 2004 No. 54, item 535, as amended), has exactly the same legal force as its paper counterpart.  
    
    
37. The Organizer declares its readiness to resolve disputes in the settlement procedure, including pursuing claims in the out-of-court ADR (Alternative Dispute Resolution) procedure. The entitled entity to which a complaint can be addressed depends on the consumer's choice. The register of such entities in Poland, along with contact details and website address, can be found here:

Any disputes between the Organizer and a customer who is not a consumer will be resolved by the court with territorial jurisdiction over the Organizer's registered office.  

38. The Organizer informs that the public nature of the Internet and the use of services provided electronically may be associated with the risk of obtaining and modifying data by unauthorized persons and infecting the User's ICT system with undesirable malware. The basic, potential risks associated with the use of the Internet include: 
    
    a) malware; 
    b) applications or scripts that have harmful, criminal or malicious activity in relation to the User's ICT system, in particular such as viruses;  
    c) spyware; 
    d) programs tracking the activities of the Website user, which collect information about the User; 
    e) spam and unsolicited and unsolicited electronic messages sent simultaneously to multiple recipients, often containing advertising content; 
    f) phishing for sensitive personal information (e.g. passwords) by impersonating a trustworthy person or institution (phishing). 
    
    
    39. In order to avoid the above risks, the user of the www.zagrywki.pl website should equip their computer and other electronic devices that they use when connecting to the Internet with an anti-virus program. Such a program should be constantly updated. Protection against threats related to the use of services provided electronically by Users is also provided by: 

a) Firewall enabled; 
b) updating all software, in particular the operating system installed on the end devices; 
d) not opening e-mail attachments of unknown origin; 
e) reading application installation windows, as well as their licenses; 
f) encryption of data transmission; 
g) using the original system and applications from a legal source. 

40. In matters not regulated in these Terms and Conditions, the relevant provisions of Polish law shall apply. 

 
Changes to the Terms and Conditions  

41. The Organizer reserves the right to change the Terms and Conditions for an important reason, which is: 

• the need to adapt the Terms and Conditions to the provisions of law that directly affect the Terms and Conditions and result in the need to modify the Terms and Conditions in order to comply with the law; 
• the need to adapt the Regulations to the recommendations, orders, rulings, provisions, interpretations, guidelines or decisions of authorized public authorities; 
• the need to adapt the Terms and Conditions to the expansion or change of the functionality of the Games, including the introduction of new services provided by the Games, 
• change in technical conditions for the provision of services; 
• the need to remove ambiguities, errors or clerical errors that may occur in the Regulations; 
• change of contact details, names, identification numbers, e-mail addresses or links included in the Terms and Conditions;
• preventing fraud and improving the quality of customer service; 
  

42. The Organizer will inform about the change of the Regulations by means of a message on the website www.zagrywki.pl 
    
    
43. Changes to the Terms and Conditions will be effective no earlier than 7 days from the date on which we notify you of such changes. 
    
    
44. Changes to the Terms and Conditions will not affect an order that has already been placed if you place them before these changes take effect, in which case we will process them on the current terms. 
    

Personal data  

45. The administrator of personal data is ABSOLUT sp. z o.o. with its registered office in Wrocław at Śliczna 7/16 Street, 50-566 Wrocław, tel. 71 77 33331 registered in the National Court Register in the Register of Entrepreneurs, under the number KRS 0000794136, entered in the REGON register under number 383921453, with the number NIP 8992865723. 
    
    
46. Personal data are processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation – hereinafter referred to as the "GDPR"). 
    
    
47. Personal data is processed for the following purposes: 
    
    a) performance of the contract or taking action at the request of the data subject prior to the conclusion of the agreement (legal basis: Article 6(1)(b) of the GDPR),  
    b) handling inquiries related to the provision of services (Article 6(1)(f) of the GDPR),  
    c) handling complaints and complaints (Article 6(1)(b) of the GDPR),  
    d) storing documentation for the purposes of establishing, pursuing or settling claims (Article 6(1)(f) of the GDPR).  
    
    
48. Providing data is voluntary, although necessary to use the service.  
    
    
49. The scope of the required data includes the provision of: name and surname, e-mail address and telephone number. This data is processed for the purpose of identifying a person or for subsequent verification. 
    
    
50. The Administrator does not transfer, sell or lend the collected data. The recipients of the data may only be authorized employees or associates of the Administrator providing services related to the process of receiving or archiving statements.  
    
    
51. Personal data is processed for the period required for the purposes of establishing, pursuing or defending legal claims. Detailed information can be found in the Privacy Policy.  
    
    
52. With regard to accounts created at the booking stage, personal data is processed until the account is deleted. After deleting the account, the Organizer has the right to process only those data that are necessary to establish, pursue or defend legal claims or data retention is required due to tax regulations.  
    
    
53. Every data subject has the right to access, rectify, delete or restrict processing of their personal data, including the right to object to processing, as well as the right to data portability and lodge a complaint with a supervisory authority. 

Additional food orders

54. The user can order snacks, cakes, cakes and drinks available in the current offer of Zagrywek. The order can be placed and modified no later than 4 days before the start of the event. 
    
    
55. The settlement of the ordered snacks, cakes, cakes and drinks takes place after the details of the order are determined - no later than 3 days before the start of the user's event. 
    
    
56. It is forbidden to consume food and drinks purchased outside the "Zagryweki" area, with the exception of the possibility of bringing your own cake/cake. In such a case, the Client is obliged to pay a cake fee of PLN 190 (in the case of =>10 Participants of the event, in a situation where there are more Participants, an additional fee of PLN 5 per person applies). In addition, the Client is obliged to sign a cake statement, on which he assumes full responsibility for safety in connection with transport and food consumption, including any claims arising from this. 

Token Activities  

57. On the spot in Zagrywki, you can buy tokens, which are a contractual means of payment and are used in activities whose result depends solely on skills. One token is equivalent to PLN 5. The token has no expiration limit. 
    
    
58. Chip activities are not games of chance, gambling or betting or any other gambling game within the meaning of the Act of 19 November 2009 on gambling. The Organizer has the right to exclude token activities from use at any time (e.g. failure, reservation of a given level for exclusive, etc.). 
    
    
59. Purchased chips are not exchangeable for cash in whole or in part in any case, are not refundable and are not exchanged for other products offered by Zagrywki. Subject to paragraph 55 of these Terms and Conditions, chips are not a means of payment and cannot be used to make purchases in the Games or in any other place. 

The Terms and Conditions of the "ZAGRYWKI BAR" Prepaid Card are valid from 10/07/2023 

Definitions 

Data Administrator / Publisher – ABSOLUT sp. z o.o. with its registered office in Wrocław at ul. Śliczna 7/16, 50-566 Wrocław, tel. 71 77 33331 registered in the National Register Court Register in the Register of Entrepreneurs, under the KRS number 0000794136, entered in the REGON register under No. 383921453, with the NIP number 8992865723. Card – an electronic goods voucher issued to the bearer in the form of a physical card, which entitles it to use in accordance with the rules set out in the Terms and Conditions. 

Client – a natural person who is a consumer within the meaning of the law, or a natural person conducting business activity in his own name or a natural person representing a legal person or an organizational unit without legal personality, who is legally capable of concluding an agreement. 

 Third party – a natural person, a legal person or an organizational unit without legal personality within the meaning of the provisions of Polish law, other than the Client and the Publisher.

force majeure – an event of an accidental or natural (natural) nature, the occurrence of which is beyond the control of the Publisher, in particular fire, explosion, power failure, earthquake, flood, cloud burst, riots, pandemic, actions of civil or military authorities, war, acts of terrorism (including cyberterrorism), cyber attacks (e.g. DDOS), actions and/and omissions of ICT network operators, other fortuitous events. 

How can I purchase the Card? 

1. The card can be purchased in 3 ways: 

a) When booking a box and/or table via the Website, 
b) By purchasing the Card by e-mail 
c) By buying stationary in Zagrywki. 

2. If the Client makes a reservation on the Website, he must meet technical requirements such as: having a device with Internet access. 
   
   
3. When booking a box and/or table via the Website, the Client will receive a Card with the value of the amount paid minus 10% of the service. The card can be picked up in Zagrywki on the day of booking. 
   
   
4. By purchasing a card by e-mail, the Client will receive a card with the value of the amount paid. If the customer wants to use the service service, then the amount paid will be reduced by 10%. The card will be available for collection in Zagrywki on a previously agreed date.  
   
   
5. When purchasing a Card in Plays, the Client, after making the payment, will receive a Card with the value of the amount paid. If the customer wants to use the service service, then the amount paid will be reduced by 10%.  A card purchased in a stationary store can be used immediately. 
   
   
6. If the Client receives the Card as a "gift" from the Issuer, the detailed rules of collection, use or value of points will be specified in a separate agreement. 
   
   
7. Reservations of boxes and tables are obligatorily subject to a service fee of 10% of the amount paid.  
   
   

How can I use the Card? 

1. The card is active at the time of collecting it in Zagrywki. 
    
2. The Card can only be redeemed for goods available in the bar, in Zagrywki, on the Card's validity date.  
   
   
3. Orders in karaoke rooms with a prepaid card can only be processed with the host.  
   
   
4. The nominal value of the Card is converted as 1 point: PLN 1. 
   
   
5. You must provide the merchant with the name or company name associated with the Card. 
   
   
6. When redeeming the Card, in connection with the purchase of goods, the nominal value of the Card will be reduced by the price due to the Issuer for the goods sold.  
   
   
7. If the value of the goods is higher than the value of points on the Card, the Client is obliged to pay the rest in cash or by payment card. 
   
   
8. The Client is not entitled to receive change in cash or on a payment card if the value of the goods received at the time of purchase is lower than the current nominal value of the Card. 
   
   
9. In the event that the Card is not used despite the expiry of the validity period, the Client has no right to demand a refund from the Issuer. The Client is obliged to collect the Card and use it. 
   
   
10. The card cannot be used to pay for activities in Zagrywki and for reservations of boxes and tables. 
    
    
11. The Issuer refuses to redeem the Charter if: 
    
    a) expired 
    b) The card has already been used, 
    c) the Issuer's staff (seller/host) will doubt whether the person who uses the Card has the right to do so (e.g. does not know the name and surname or the name of the company to which the Card is assigned). The Card is assigned the place and time of the reservation (these data are not visible on the Card) and the Seller may ask for their provision in case of doubt as to whether the authorized person uses the Card, d) the Issuer's staff (seller/host) will question whether the sale of alcohol is allowed for the person who uses the Card. 
     

12. Card: 

a) is not exchangeable for cash in whole or in part, 
b) is not an electronic payment instrument, an electronic money instrument or a payment card within the meaning of the law, 
c) has a nominal value (points to be used for purchases in accordance with Regulations), but this value cannot be exchanged for any money, 
d) is an electronic voucher. Execution of a transaction via the Card will constitute a valid transaction also in the event that a third party uses the Client's Card, but knows the bearer's data (it is then assumed that the Client has entrusted such a person with the Card for use).   

How long is the Card valid for and how to top it up? 

1. The card is valid for 1 year from the moment of receipt and cannot be used after its expiry date.   
   
2. The card can be topped up to extend its validity.  
   
   
3. The top-up can be done in the area of Zagryweki.  
   
   
4. The minimum top-up value is PLN 50.   
   
   
5. The number of points corresponding to the nominal value of the Card is the difference between the value of the top-up (e.g. PLN 50) and 5 points charged for the maintenance service, i.e. delivering products to the table (50 – 5 = 45). 

 
How do we process your personal data? 

1. Personal data is processed in accordance with the Privacy Policy of Zagrywek, available on the Website. 
   
   
2. The Issuer may send notifications to the e-mail address provided by the Client informing about: reminder of the receipt of the Card, the approaching expiry of the Card's expiry date, top-up of the Card, etc. 
   
   

Complaints 

1. Complaints should be submitted electronically to the e-mail address [email protected] 
   
   
2. In the report, please indicate the most accurate description of the irregularities (taking into account, for example, the time and place of occurrence and any indication of the method of resolving the complaint).   
   
   
3. The complaint is considered as soon as possible, not longer than 14 days.   
   
   
4. The day of filing the complaint is the day of receipt of the complaint to the Issuer.   

 
Rights and obligations 

1. The Client has the right to: 

a) use the Card in accordance with the Terms and Conditions, 
b) directing inquiries to the Issuer's service in connection with the use of the Card and/or filing a complaint, 

2. The Client undertakes: 

a) use data and/or personal data in respect of which they have full right to use, 
b) check whether they meet the requirements to use the Card,
c) not to use the Card in a way that violates the law, the provisions of the Terms and Conditions and the rules of social coexistence. It is prohibited to use it for the purpose of conducting terrorist, sabotage or other criminal activities, as well as to commit any violations of the law and committing delicts,   
d) not to undertake any actions that are inconsistent with the provisions of generally applicable law or good morals, as well as violating the personal rights of other persons (including legal persons) or the legitimate interests of the Publisher or other persons (including legal persons), 
e) Not access other people's Cards.  
f) not to interfere with the Card infrastructure, including its content, not to break security, not to duplicate,  
g) not to be placed on the market, 
h) take care of the security of the Card, do not entrust it to third parties. 

3. The Publisher undertakes to make every effort to ensure the proper provision of services on a continuous and uninterrupted basis. However, the Issuer reserves the right to temporarily unavailability of the Cards due to force majeure. The Publisher will make every effort to make this unavailability as inconvenient as possible for the Client.    

Final provisions 

1. The Publisher reserves the right to make changes to the Terms and Conditions. Each document is marked with the date from which its provisions apply. 
   
   
2. In the event of a change in the Terms and Conditions during the execution of the order, the provisions in force on the date of commencement of the order shall apply. 
   
   
3. In matters not regulated in the Terms and Conditions, the relevant provisions of Polish law and/or the provisions applicable to the place of residence of the consumer's law or the terms of the agreement concluded between the parties shall apply. 
   
   
4. In the event of amendment and/or annulment as a result of a final court decision of any of the provisions of the Terms and Conditions, the remaining provisions shall remain in force. 
   
   
5. The Publisher declares its readiness to resolve disputes in the settlement procedure, including pursuing claims in the out-of-court ADR (Alternative Dispute Resolution) procedure. In this case, please submit your complaints using the website:

6.
