- These Terms and Conditions (hereinafter referred to as the ‘Terms and Conditions’) regulates the rules for using the activity bar called Zagrywki (hereinafter referred to as ‘Zagrywki’), located in Warsaw, at ul. Nowy Świat 4a, 00-497 Warsaw, : https://zagrywki.pl/en/warszawa/kontakt , e-mail: [email protected].
- Zagrywki is managed by Gravity Park Sp. z o.o. with its headquarter located in Warsaw at 35 Goplańska Street, 02-954 Warsaw, tel. 22 123 55 66 registered into The National Court register in The Register of Entrepreneurs under the number 0000514593, entered in The National Official Business Register, REGON under the number 147296989, tax identification number NIP 9512380720, with share capital of PLN 5,000.00, hereinafter referred to as the Organiser.
- All persons using Zagrywki, (hereinafter referred to as the Users), are obliged to read these Terms and Conditions. Entering Zagrywki premises is tantamount to reading and accepting these Terms and Conditions.
- In order to use the activities available at Zagrywki, one must have a valid admission ticket (ticket types and prices are available at the ticket offices and on the website www.zagrywki.pl).
- The User acknowledges that during one’s stay at Zagrywki, one must strictly follow the instructions of the staff.
- A visit to the Zagrywki may be subject to compliance with other terms and conditions, the content of which the User is obliged to read. The regulations referred to in the previous sentence concern:
a) Prepaid Cards
b) Event Organisation in Zagrywki;
d) using the cloakroom;
e) the ‘Hit and Win’ action;
f) Gift Cards. - A service fee, of 10% of the order value, applies for all orders placed with hosts at Zagrywki premises.
For organised groups of more than 8 people who have made a reservation via e-mail and/or in the case of seat reservations, the Organiser reserves the right to charge a service fee of 10% of the order value placed during the reservation, regardless of where the order is placed or the method of payment.
- On the premises of Zagrywki it is forbidden to:
a) consume food and beverages purchased outside the premises of Zagrywki,
b) bring in and use intoxicants or psychotropic substances,
c) bring in weapons, explosives, pyrotechnic materials or other items that pose a threat to the safety of Users,
d) enter rooms marked as service rooms,
e) behave in an aggressive or provocative manner or that otherwise poses a threat to other Users. - Users are obliged to show the contents of their clothing and luggage ,brought into Zagrywki, to the security guard upon request.
- The facility sells beverages (including alcoholic beverages) for consumption on the premises only.
- Zagrywki’s premises are monitored by CCTV cameras. The image is recorded to ensure the safety of the users of Zagrywki without prejudice to their personal rights. Detailed information can be found in the Privacy Policy.Streaming, live recording and any other commercial use without prior marketing consent is prohibited. Recording for personal use is permitted provided that it does not violate the law or good manners. Zagrywki staff have the right to warn or ask to leave any person who records or streams in violation of the Terms and Conditions.
- Persons staying at Zagrywki consent to the free use and distribution of their image, recorded during their stay at Zagrywki, for the Organiser's marketing purposes. This consent is granted for an indefinite period of time and without territorial restrictions for the Organiser and is granted for all known fields of use, including in particular use and exploitation on the Internet, including on social networking sites such as Facebook, Instagram, public reproduction and sharing, recording, reproduction and publication in any form and technique, including on copies of flyer, posters, etc. The Organiser ensures that the image of Users will not be used in a manner that is ridiculing, undignified, scandalous, compromising or defamatory, or for the purpose of promoting violence, hatred, discrimination, pornography or drugs. By accepting these Terms and Conditions, Users waive their right to verify and/or approve materials containing their image.
Age
- From 6 p.m., only persons of legal age are allowed on the premises of Zagrywki. Minors are not allowed to purchase tickets for activities starting after 6 p.m. – the purchase is available after positive verification of the User's age, i.e. after the User has submitted a declaration of legal age (Age Gate). The Organiser reserves the right to refuse entry or ask minors to leave the Zagrywki’s premises after 6 p.m. In such a case, the Organiser may refuse to redeem tickets at the User's risk and expense.
- When purchasing tickets for individual activities, the Organiser allows Users to place orders for selected alcoholic beverages. The ordered drinks are served only on site during the activity to which the purchased ticket applies. The offer to order alcoholic beverages and the possibility to place such an order are available only to persons of legal age, and the content of such an offer becomes visible only after submitting a declaration of legal age (Age Gate). It is not possible for minors to purchase alcohol.
- The Organiser reserves the right to verify the User's age on the basis of an identity document. The Organiser notes that the staff does not verify age on the basis of: student ID cards, school ID cards, scans of documents, photos of documents, screenshots of documents, health cards on mobile phones, consent from a legal guardian, COVID passports, etc. Acceptable documents include: ID card, passport, driving licence, mObywatel, sailing licence, residence card, resident card. Failure to meet the above requirements may result in refusal of entry or removal from the Zagrywki premises and non-realisation of tickets at the User's risk and expense. In such a case, the Organiser does not refund the cost of the tickets to the User.
- In the case of orders for alcoholic beverages placed via the website, or for the Beer Pong activity, the User's age is verified on the basis of an identity document. It is not possible for minors to purchase alcohol.
If alcohol is purchased via the website by a minor on the basis of a false declaration of ;egal age, the Organiser reserves the right not to fulfil the order at the risk and expense of the User.
- Subject to paragraph 13, children up to the age of 13 inclusively, may use the activities in Zagrywki only under the supervision of an adult who must stay on the premises of the facility.
Liability
- The Organiser does not provide childcare services for children and youth.
- The Organiser is not liable for any destruction or damage to the belongings of the users of Zagrywki, with the exception of detriment caused by Zagrywki.
- The Organiser is not financially liable for items lost or left on the premises of Zagrywki and in its vicinity. If found by a staff member of the Organiser or handed over by a third party to the reception desk, items lost or left at Zagrywki can be picked up at the reception desk within 7 business days
- The Users utilise the activities at Zagrywki at their own risk. The Organiser bears no liability for any damage suffered by Users, including injuries, bodily harm and their consequences, except for detriment caused by the Organiser's fault.
- In particular, the Organiser bears no responsibility for any damage arising from the improper use of the infrastructure of Zagrywki not in accordance with instruction and recommendations of the personnel or through the sole fault of the user of the activity.
- The Organisers’s employees have the right to not let one in or to ask one to leave the Zagrywkis premises if one’s behaviour endangers the safety of themselves or other persons in Zagrywki.
- In the event of a large number of people on the premises, the Organiser's employees may give priority to persons with a valid reservation. Persons who have not been able to enter Zagrywki in the situation referred to in the previous sentence shall not be entitled to any claims.
Ticket sales
- The Organiser conducts online sale of admission tickets to Zagrywki online at https://zagrywki.pl/en/warszawa, where website users can place their orders. It is also possible to purchase tickets on the basis of a separate agreement or event terms and conditions. These Terms and Conditions constitute, in the scope of services provided electronically consisting in the sale of tickets, the regulations for the provision of electronic services referred to in Article 8(1)(1) of the Act of 18 July 2002 on the provision of electronic services.
- The functionality of the website https://zagrywki.pl/en/warszawa enabling the purchase of tickets is an electronic service which is voluntary and one-off, and the agreement for its provision is concluded at the moment of starting to fill in the relevant form, and ends when the order confirmation referred to in section 29 of these Terms and Conditions is sent or when the user decides not to complete the form.
- The person ordering the ticket and making payment purchases the right to participate in the activity at Zagrywki within the time specified on the ticket. The Organiser does not extend the duration of the activity in the event of the User's late arrival, regardless of the reason for the delay. The Organiser reserves the right to refuse the User entry to the activity if the delay prevents them from participating in the activity within the time specified on the ticket.
- When placing an order via the website, the User is required to choose the date and time of the entry, the type and amount of tickets, the method of payment for the tickets, and to read and accept the Terms and Conditions of the facility, which is a condition for the execution of the order.
- After placing an order, the user receives an email confirming that the order was received by the System (ORDER CONFIRMATION)..
- The ticket purchase price is binding for the Organiser and for the buyer at the time of the buyer's submission order for the purchase of a given ticket.
- The Organiser reserves the right to change: prices and types of tickets. The above right does not affect the performance of concluded contracts and orders placed before the effective date of such changes.
- One person can purchase an unlimited number of available for sale admission tickets for the activities in Zagrywki at a time.
- The number of tickets purchased cannot be increased unless the Organiser decides otherwise. The maximum number of additional tickets after the Organiser's consent is: 2.
- The Organiser is not liable for failure to place an order or failure to deliver order confirmation or/and fiscal document, inability to make payment due to an incorrect or inaccurate address provided by the customer or problems with Internet connection, or other circumstances beyond the organiser’s control.
Pursuant to Article 38(12) of the Act on Consumer Rights of 30 May 2014, the consumer is not entitled to withdraw from an off-premises contract or from a distance contract as this right does not apply in relation to contracts for leisure services, or entertainment, sport or cultural events, if the contract specifies a day or a period of provision of the service.
- Complaints regarding electronic payments are handled by the PayU service. The user sends the complaint to the correspondence address of Zagrywki, which is later forwarded to the PayU service. The complaint should contain the following information: name and surname, date, number and the amount of transaction.. PayU undertakes to ensure full and comprehensive complaint handling.
- In cases other than those specified in point 36, complaints shall be considered by the Organiser within 14 days of receipt of the complaint at the Organiser's correspondence address.
- Credit card and e-transfer transactions are settled via PayU.
- When making a purchase via the Organiser's website, the buyer, upon acceptance of these Terms and Conditions, agrees to receive fiscal documents in the form of an electronic receipt or invoice (depending on the buyer's choice) to the e-mail address provided when placing the order. If the buyer does not agree, they are obliged to interrupt the online ordering process and, if they wish to receive a paper version of the fiscal document, they are obliged to place their order at site.
- The Organiser issues and sends invoices and electronic receipts, guaranteeing their authenticity and integrity. In accordance with the Act of 11 March 2004 on Goods and Services Tax (Journal of Laws of 2004, No. 54, item 535, as amended), an electronic fiscal document has exactly the same legal force as its paper counterpart.
- The Organiser declares their availability to resolve disputes in an amicable manner, including vindication of claims in out-of-court proceedings ADR (Alternative Dispute Resolution). Any disputes between the Organiser and a non-consumer customer will be settled by the local court for the headquarters of the Organiser
- The Organiser informs that the public nature of the Internet and the use of electronic services may involve the risk of unauthorised persons obtaining and modifying data, as well as infecting the User's ICT system with unwanted, malicious software. The basic potential risks associated with using the Internet include:
a) malware;
b) applications or scripts that have harmful, criminal or malicious effects on the User's ICT system, in particular viruses;
c) spyware;
d) programmes that track the activities of Website users and collect information about them;
e) spam and unwanted and unsolicited electronic messages sent simultaneously to multiple recipients, often containing advertising content;
f) phishing, i.e. obtaining confidential personal information (e.g. passwords) by impersonating a trustworthy person or institution. - In order to avoid the above risks, users of the https://zagrywki.pl/en/warszawa website should equip their computers and other electronic devices used to connect to the Internet with antivirus software. Such software should be kept up to date. Protection against risks associated with the use of electronic services by users is also provided by:
a) an enabled firewall;
b) updating all software, in particular the operating system installed on end devices;
c) not opening email attachments of unknown origin;
d) reading application installation windows and their licences;
e) encrypting data transmission;
f) using original systems and applications from legal sources. - Any matters not included in these Terms and Conditions are regulated by the relevant Polish laws.
Amendments to the Terms and Conditions
45. The Organiser reserves the right to amend the Terms and Conditions for important reasons, such as:
- the need to adapt the Terms and Conditions to legal provisions that have a direct impact on the Terms and Conditions and result in the need to modify the Terms and Conditions in order to comply with the law;
- the need to adapt the Terms and Conditions to the recommendations, orders, rulings, decisions, interpretations, guidelines or decisions of competent public authorities;
- the need to adapt the Terms and Conditions to the expansion or change of functionality of Zagrywki, including the introduction of new services provided by Zagrywki;
- a change in the technical conditions for the provision of services;
- the need to remove ambiguities, errors or typographical mistakes that may occur in the Terms and Conditions;
- changes to contact details, names, identification numbers, e-mail addresses or links included in the Terms and Conditions;
- counteracting abuse and improving customer service quality;
46. The Organiser shall notify one of any changes to the Terms and Conditions via a notice on the website www.zagrywki.pl.
47. Changes to the Terms and Conditions shall take effect no earlier than 7 days after the date on which we notify of such changes.
48. Changes to the Terms and Conditions will not affect orders already placed if one places them before these changes come into effect – in this case, we will process them according to the existing rules.
Personal data
49. The administrator of personal data is Gravity Park sp. z o. o. with its registered office in Warsaw at ul. Goplańska 35, 02-954 Warsaw, tel. 22 123 55 66, registered in the Register of Entrepreneurs of the National Court Register under number 0000514593, entered in the REGON register under No. 147296989, with NIP No. 9512380720, with share capital of PLN 5,000.00.
50. Personal data shall be processed in accordance with Regulation 2016/679 of the European Parliament and of the Council (EU) of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing the 95/46/EC Directive (General Data Protection Regulation – hereinafter referred to as “GDPR”).
51. Personal data is processed for the purposes of:
- performance of the contract or taking action on request the data subject before concluding the contract (Article 6 (1) (b) of the GDPR),
- handling inquiries related to the implementation of services (Article 6 (1) (f) of the GDPR),
- handling complaints (Article.6 (1) (b) of the GDPR),
- keeping documentation for the needs of establishing, investigating or settling claims (Article 6 (1) (f) of the GDPR).
52. Providing data is voluntary, however necessary to use the service.
53. The scope of the required data includes the provision of: first and last name, e-mail address and phone number. This data is processed for the purpose of identification of the person or subsequent verification.
54. The Administrator shall not transfer, sell or lend the collected data. Data shall only be disclosed to authorised employees or associates of the administrator providing services related to the process of accepting or archiving statements.
55. Personal data is processed for the period required to establish, assert or defend legal claims. Detailed information can be found in the Privacy Policy.
56. With regard to accounts created during the booking stage, personal data is processed until the account is deleted. After deleting the account, the administrator has the right to only process the data that is necessary for establishing, pursuing or defending legal claims or data retention is required due to tax regulations
57. Each data subject shall have the right to access, rectify, erase or limit the processing of their personal data, including the right to object to the processing, as well as the right to transfer the data and lodge a complaint with the supervisory authority.
Token activities
58. Tokens can be purchased on site at Zagrywki. They are a conventional means of payment and are used in activities whose outcome depends solely on skill. One token is equivalent to PLN 6. Tokens have no expiry date.
59. Token activities are not games of chance, gambling, betting or any other form of gambling within the meaning of the Gambling Act of 19 November 2009. The Organiser has the right to disable token activities at any time (e.g. in the event of a failure, exclusive reservation of a given level, etc.).
60. Purchased tokens cannot be exchanged for cash in whole or in part under any circumstances, are non-refundable and cannot be exchanged for other products offered by Zagrywki. Subject to paragraph 58 of these Terms and Conditions, tokens are not a legal tender and cannot be used to make purchases at Zagrywki or anywhere else.
Terms and Conditions of the ‘ZAGRYWKI BAR’ Prepaid Card

Definitions
Data Administrator/ Issuer – Gravity Park Sp. z o. o. with its registered office in Warsaw at ul. Goplańska 35, 02-954 Warsaw, tel. 22 123 55 66, registered in the National Court Register in the register of entrepreneurs under number 0000514593, entered in the REGON register under number 147296989, with NIP number 9512380720. Correspondence address: Zagrywki, Nowy Świat 4a, 00-497 Warsaw.
Card – an electronic gift token issued to the bearer in the form of a physical card, which entitles the holder to use it in accordance with the rules set out in the Terms and Conditions.
Customer – a natural person who is a consumer within the meaning of the law, or a natural person conducting business activity on their own behalf, or a natural person representing a legal person or an organisational unit without legal personality, which is legally capable of concluding a contract.
Third party – a natural person, legal person or organisational unit without legal personality within the meaning of Polish law other than the Customer and the Issuer.

GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC.

force majeure – an accidental or natural (elemental) event beyond the Publisher's control, in particular fire, explosion, power failure, earthquake, flood, cloudburst, riots, pandemic, actions of civil or military authorities, war, acts of terrorism (including cyberterrorism), cyberattacks (e.g. DDOS), actions and/or omissions of ICT network operators, other random events.

How can I purchase the Card?
1. The Card can be purchased in three ways:
- By reserving a seat via the Website or by e-mail,
- By purchasing the Card by e-mail or in person at Zagrywki,
- By receiving it as a gift from the Issuer.
2. If the Customer makes a reservation on the Website, they must meet technical requirements such as having a device with Internet access.
3. When making a seat reservation, the Customer will receive a card for the amount paid. When paying by Card, the amount paid will be reduced by 10% of the order value, regardless of where the order is placed. The Card can be collected at Zagrywki on the day of the reservation.
4. When purchasing a card by e-mail for a reservation for a group of 8 or more people, the Customer will receive a card for the amount paid.
When paying by Card, the amount paid will be reduced by 10% of the order value, regardless of where the order is placed. The Card can be collected at Zagrywki on a pre-agreed date.
5. When purchasing a Card at Zagrywki or by email for reservations for groups of less than 8 people, the Customer will receive a Card for the value of the amount paid after making the payment. If the Customer wishes to use the service, the amount paid will be reduced by 10% of the order value. A Card purchased in person can be used immediately.
6. If the Customer receives the Card as a ‘gift’ from the Issuer, the detailed rules for receiving, using and the value of points will be specified in a separate agreement.
7. Seat reservations and reservations made by e-mail for groups of 8 or more people are subject to a mandatory service fee of 10% of the order value during the reservation period, regardless of where the order is placed.
How can the Card be used?
1. The Card is active upon collection at Zagrywki.
2. The Card can only be redeemed for goods available at the bar, at Zagrywki, on the Card's expiry date.
3. The nominal value of the card is calculated as 1 point: PLN 1.
4. The name and surname or company name assigned to the Card must be provided to the Issuer.
5. When redeeming the Card for the purchase of goods, the nominal value of the Card will be reduced by the price due to the Issuer for the goods sold and a service fee, if
applicable.
6. If the value of the goods is higher than the value of the points on the Card, the Customer is obliged to pay the difference in cash or by payment card.
7. The Customer is not entitled to receive change in cash or on a payment card if the value of the goods received at the time of purchase is lower than the current nominal value of the Card.
8. If, despite the expiry of the Card's validity period, it remains unused, the Customer shall not be entitled to demand a refund from the Issuer. The Customer is obliged to collect the Card and use it.
9. The Card cannot be used to pay for activities in Zagrywki or for seat reservations.
10. The Issuer shall refuse to accept the Card if:
a) it has expired,
b) the Card has already been used,
c) the Issuer's staff (salesperson/host) has doubts as to whether the person using the Card is entitled to do so (e.g. they do not know the name and surname or company name to which the Card is assigned). The Card is assigned a place and time of reservation (this information is not visible on the Card) and, in case of doubt as to whether the authorised person is using the Card, the Issuer may ask for this information to be provided,
d) the Issuer's staff (seller/host) will question whether the sale of alcohol is permitted to the person using the Card.
11. Card:
a) cannot be exchanged for cash, either in whole or in part,
b) is not an electronic payment instrument, electronic money instrument or payment card within the meaning of the law,
c) has a nominal value (points to be used for purchases in accordance with the Terms and Conditions), but this value cannot be exchanged for any cash,
d) is an electronic gift voucher. Transactions made using the Card shall also be considered valid if a third party uses the Customer's Card but knows the bearer's details (in which case it is assumed that the Customer has entrusted the Card to that person for use).
How long is the Card valid and how can it be topped up?
1. The Card is valid for 1 year from the date of receipt and cannot be used after its expiry date.
2. The Card can be topped up to extend its validity.
3. Top-ups can be made at Zagrywki.
4. The minimum top-up amount is PLN 50.
5. The number of points corresponding to the nominal value of the Card is the difference between the top-up amount (e.g. PLN 50) and 5 points charged for the service, i.e. delivery of products to the table (50 – 5 = 45).
6. Recharging a Card issued for a group booking of 8 or more people who made a booking by email and/or for seat reservations, during the booking period is done on the same Card. The customer will receive a top-up on the Card for the amount paid. When making a payment with a topped-up Card, the amount paid will be reduced by 10% of the order value, regardless of where the order was placed.
7. Top-ups for Cards purchased at Zagrywki or by email for reservations for groups of less than 8 people are made to the same Card. After making the payment, the customer will receive a top-up to the Card for the amount paid. If the customer wishes to use the service, the amount paid will be reduced by 10% of the order value.
8. The Organiser reserves the right to issue a new Card in the event of a request to top up funds on a Card issued for the booking of an organised group of 8 or more people who made the booking by email and/or for the booking of seats, if the Customer wishes to top up the Card after the booking has been completed. After making the payment, the Customer will receive a Card with the value of the amount paid. If the Customer wishes to use the service, the amount paid will be reduced by 10% of the order value.
How do we process your personal data?
1. Personal data is processed in accordance with Zagrywki’s Privacy Policy, available on the Website.
2. The Issuer may send notifications to the e-mail address provided by the Customer informing them about: a reminder to collect the Card, the approaching expiry date of the Card, reloading the Card, etc.
Complaints
1. Complaints should be submitted electronically to the following e-mail address: [email protected]
2. Please provide as detailed a description of the irregularity as possible in your complaint (including, for example, the time and place of occurrence and any suggestions for resolving the complaint).
3. Complaints will be considered as soon as possible, within 14 days at the latest.
4. The date of receipt of the complaint by the Issuer shall be deemed the date of submission of the complaint.
Rights and obligations
1. The Customer has the right to:
a) use the Card in accordance with the Terms and Conditions,
b) submit enquiries to the Issuer's customer service regarding the use of the Card and/or lodge complaints,
2. The Customer undertakes to:
a) use data and/or personal data which they have full rights to use,
b) check whether they meet the requirements for using the Card,
c) not to use the Card in a manner that violates the law, the provisions of the Terms and Conditions, or the principles of social coexistence. It is prohibited to use the Card for the purpose of conducting terrorist, sabotage, or other criminal activities, as well as to commit any violations of the law or offences,
d) not to take any actions that are contrary to generally applicable law or good manners, or that violate the personal rights of other persons (including legal persons) or the legitimate interests of the Issuer or other persons (including legal persons),
e) not to access other persons' Cards,
f) not to interfere with the Card infrastructure, including its content, not to break security measures, not to duplicate,
g) not to put into circulation,
h) to ensure the security of the Card, not to entrust it to third parties.
3. The Issuer undertakes to make every effort to ensure the proper provision of services on a continuous and uninterrupted basis. However, the Issuer reserves the right to temporarily suspend the use of Cards due to force majeure. The Issuer shall make every effort to ensure that such unavailability is as least disruptive as possible to the Customer.
Final provisions
1. The Issuer reserves the right to amend the Terms and Conditions. Each document is marked with the date from which its provisions are effective.
2. In the event of an amendment to the Terms and Conditions during the execution of an order, the provisions in force on the date of commencement of the order shall apply.
3. In matters not covered by the Terms and Conditions, the relevant provisions of Polish law and/or the provisions applicable to the place of residence of the consumer or the terms of the agreement between the parties shall apply.
4. In the event of a change and/or invalidation of any provision of the Terms and Conditions as a result of a final court ruling, the remaining provisions shall remain in force.
5. The Issuer declares its readiness to resolve disputes through settlement, including pursuing claims through out-of-court ADR (Alternative Dispute Resolution). In such cases, please submit your complaints via the website:

6. Any disputes between the Issuer and a non-consumer customer will be settled by the local court for the headquarters of the Organiser.
