1. These Terms and Conditions (hereinafter referred to as the "Terms and Conditions") govern the use of the activity bar called Zagrywki (hereinafter referred to as "Zagrywki"), located in Warsaw, at ul. Nowy Świat 4a, 00-497 Warsaw, https://zagrywki/warszawa/kontakt/, e-mail: [email protected].
2. Zagrywki is managed by Gravity Park sp. z o. o. with its registered office in Warsaw, at ul. Goplańska 35, 02-954 Warsaw, tel. +48 22 123 55 66, registered in the Register of Entrepreneurs of the National Court Register maintained by the District Court for the capital city of Warsaw. Warsaw, 13th Commercial Division of the National Court Register under No. 0000514593, entered in the REGON register under No. 147296989, Tax Identification Number (NIP) 9512380720, with share capital of PLN 5,000.00, hereinafter referred to as the "Organizer."
3. All persons using Zagrywki (hereinafter referred to as "Users") are required to read these Regulations. Entering the Zagrywki premises constitutes acceptance of the Regulations by the User.
4. A valid admission ticket is required to participate in the activities offered at Zagrywki (ticket types and prices are available at the ticket offices and on the website www.zagrywki.pl).
5. The User acknowledges that during their stay on the Zagrywki premises, the instructions of the staff must be strictly followed. Staying on the Zagrywki premises may require compliance with other regulations, the content of which the User is obligated to familiarize themselves with. The regulations referred to in the preceding sentence apply to:
a) prepaid cards;
b) event organization;
d) use of the cloakroom;
e) the "Hit and Win" promotion;
f) gift cards.
7. A service fee of 10% of the order value applies to all orders placed with hosts on the Zagrywki premises.
For organized groups of more than 8 people who made reservations via email and/or in the case of seat reservations, the Organizer reserves the right to charge a service fee of 10% of the order value placed during the reservation process, regardless of the ordering location or payment method. 8. On the Zagrywki premises, it is prohibited to:
a) consume food and beverages purchased outside the Zagrywki premises,
b) bring in or use narcotics or psychotropic substances,
c) bring in weapons, explosives, pyrotechnics, or other items that threaten the safety of Users,
d) enter rooms designated as official premises,
e) engage in aggressive, provocative, or otherwise dangerous behavior to other Users.
9. Users are required to present the contents of their clothing and luggage brought into Zagrywki to a security staff member upon request.
10. CCTV cameras are used to record images on the Zagrywki premises. The images are recorded to ensure the safety of individuals staying on the Zagrywki premises while maintaining the integrity of their personal rights. Detailed information can be found in the Privacy Policy. Streaming, recording live broadcasts, or any other commercial use without prior marketing consent is prohibited. Recording for personal use is permitted provided it does not violate the law or good manners. Zagrywki staff has the right to reprimand or ask anyone who records or streams in violation of these Terms and Conditions to leave. 11. Persons staying at Zagrywki consent to the free use and dissemination of their image, recorded during their stay at Zagrywki, for the Organizer's marketing purposes. Consent is granted for an indefinite period and without territorial restrictions for the Organizer and is granted for all known fields of exploitation, including in particular use and exploitation on the Internet, including on social networking sites such as Facebook, Instagram, public reproduction and sharing, recording, reproduction and publication in any form and technique, including on copies of leaflets, posters, etc. The Organizer guarantees that the image of Users will not be used in a ridiculing, dishonorable, scandalous, compromising or defamatory manner, or for the purpose of promoting violence, hatred, discrimination, pornography or drugs. By accepting these Regulations, Users waive the right to verify and/or accept materials containing their image/
Age
12. From 6:00 PM, only adults are allowed on the Zagrywki premises.
13. The Organizer reserves the right to verify User's age based on an ID document. The Organizer notes that it does not verify age based on: student ID, school ID, document scans, document photos, document screenshots, health records on a phone, consent from a legal guardian, COVID passport, etc. Acceptable documents include: ID card, passport, driving license, mObywatel, sailor's card, residence card, resident card. Failure to meet the above requirements may result in refusal of entry or removal from the Zagrywki premises, and non-acceptance of tickets at the User's risk and expense. In such a case, the Organizer will not refund the User's ticket costs.
14. Age verification for the Beer Pong activity is based on an ID document. Minors are not permitted to purchase alcohol.
15. Subject to paragraph 4. Twelve children up to 13 years of age may participate in the activities at Zagrywki only under the supervision of an adult, who must be present on the Zagrywki premises.
Liability
16. The Organizer does not provide childcare services for children and adolescents.
17. The Organizer is not responsible for any destruction or damage to items belonging to persons staying on the Zagrywki premises, except for damage caused by the Organizer's fault.
18. The Organizer is not liable for any items lost or left in Zagrywki or its surroundings. Items lost or left in Zagrywki, if found by an Organizer employee or returned by a third party to the reception desk, may be collected from the Zagrywki reception desk within 7 business days.
19. Participants participate in the activities at Zagrywki at their own risk. The Organizer is not liable for any damage to participants, including injuries, bodily harm, or their consequences, except for damage caused by the Organizer's fault.
20. In particular, the Organizer is not liable for any damage resulting from improper use of the Zagrywki infrastructure, contrary to the instructions and instructions of the staff, or the sole fault of the person using the activity.
21. Organizer employees may ask to exclude or refuse entry to any person whose behavior threatens their safety or the safety of others at Zagrywki.
22. In the event of a large number of people on the premises, Organizer employees may allow entry first to those with a valid reservation. Users who are not admitted to the Zagrywki premises in the situation referred to in the preceding sentence are not entitled to any claims in this regard.
Ticket Sales
23. The Organizer conducts online sales of tickets to Zagrywki on the website www.zagrywki.pl, through which website users place orders. Tickets can also be purchased based on a separate agreement or event regulations. These Regulations constitute, with respect to services provided electronically involving ticket sales, the regulations for the provision of electronic services referred to in Article 8, Section 1, Item 1 of the Act of 18 July 2002 on the provision of electronic services.
24. The functionality of the website www.zagrywki.pl enabling the purchase of tickets is an electronic service that is voluntary and one-time. The agreement for its provision is concluded upon commencement of completion of the relevant form and terminates upon sending the order confirmation referred to in Section 27 of these Regulations or upon cancellation of completion of the form.
25. The person ordering a ticket and paying the fee purchases the right to participate in the Zagrywki activity within the period specified on the ticket. The Organizer does not extend the duration of an activity due to a User's delay, regardless of the reason for the delay. The Organizer reserves the right to refuse admission to an activity if the delay prevents the User from participating in the activity within the time specified on the ticket.
26. When placing an order via the website, the User is required to select the entry date and time, type and number of tickets, payment method, and to read and accept the Terms and Conditions, which is a condition for order fulfillment.
27. After placing the order, the User will receive an email confirming that the order has been received in the System (ORDER CONFIRMATION).
28. The ticket purchase price is binding on the Organizer and the Buyer at the time the Buyer places the order for a given ticket.
29. The Organizer reserves the right to change ticket prices and ticket types. This right does not affect the fulfillment of concluded contracts and orders placed before the effective date of such changes.
30. One person may purchase any number of available tickets for the activity at Zagrywki at one time.
31. The number of purchased tickets cannot be increased unless the Organizer decides otherwise. The maximum number of additional tickets after the Organizer's consent is: 2.
32. The Organizer is not responsible for failure to place an order or receive order confirmation, inability to pay due to an incorrect or inaccurate address provided by the Customer, internet problems, or other circumstances beyond the Organizer's control.
33. Ticket refunds are not available for both online and in-store purchases at Zagrywki. Upon individual decision, but no later than 24 hours before the planned reservation, the Service Provider, in consultation with the Customer, may provide a discount code or change the date of the event/ticket.
Pursuant to Article 38, Section 12 of the Consumer Rights Act of May 30, 2014, the purchaser of an admission ticket does not have the right to withdraw from a distance contract, as this right does not apply to consumers in the case of contracts for services related to leisure, entertainment, or sporting events, if the contract specifies the date or period of service provision.
34. Complaints regarding electronic payments are handled by PayU. The user should send the complaint to the correspondence address of Zagrywki, which forwards it to PayU. The complaint should include the following information: name, surname, date, number, and transaction amount. PayU undertakes to provide a full and comprehensive complaint handling service.
35. In cases other than those listed in Section 34, the Organizer will review complaints within 14 days of receipt of the notification at the Organizer's correspondence address.
36. Credit card and e-transfer transactions are settled via PayU.
37. The Organizer issues and sends electronic invoices, guaranteeing the authenticity of their origin and the integrity of their content. Pursuant to the Act of 11 March 2004 on Goods and Services Tax (Journal of Laws of 2004, No. 54, item 535, as amended), an electronic invoice has exactly the same legal force as its paper counterpart.
38. The Organizer declares its willingness to resolve disputes amicably, including pursuing claims through out-of-court ADR (Alternative Dispute Resolution) procedures. Any disputes between the Organizer and a customer who is not a consumer will be resolved by the court having jurisdiction over the Organizer's registered office.
39. The Organizer hereby informs that the public nature of the Internet and the use of services provided electronically may involve the risk of unauthorized access and modification of data and the infection of the User's IT system with unwanted malware. The basic potential threats associated with using the Internet include:
a) malware; b) applications or scripts that have harmful, criminal, or malicious effects on the User's IT system, in particular viruses;
c) spyware;
d) programs that track the actions of the Website user and collect information about the User;
e) spam and unsolicited and unsolicited electronic messages sent simultaneously to multiple recipients, often containing advertising content;
f) obtaining confidential personal information (e.g., passwords) by impersonating a trustworthy person or institution (Phishing).
40. To avoid the above threats, users of the www.zagrywki.pl website should equip their computers and other electronic devices they use to connect to the Internet with antivirus software. This software should be constantly updated. Protection against threats related to the use of services provided electronically is also ensured by:
a) an enabled firewall;
b) updating all software, in particular the operating system installed on end devices;
c) not opening email attachments of unknown origin;
d) reading application installation windows and their licenses;
e) encrypting data transmission;
f) using genuine systems and applications from legal sources.
41. In matters not regulated in these Terms and Conditions, the relevant provisions of Polish law shall apply.
Amendments to the Regulations
42. The Organizer reserves the right to amend the Regulations for important reasons, such as:
- the need to adapt the Regulations to legal provisions that directly impact the Regulations and require modification of the Regulations to maintain legal compliance;
- the need to adapt the Regulations to recommendations, orders, rulings, provisions, interpretations, guidelines, or decisions of authorized public authorities;
- the need to adapt the Regulations to the expansion or change of Zagrywki's functionality, including the introduction of new services provided by Zagrywki;
- changes to the technical conditions for the provision of services;
- the need to remove ambiguities, errors, or typographical errors that may appear in the Regulations;
- changes to contact details, names, identification numbers, email addresses, or links provided in the Regulations;
- to prevent abuse and improve the quality of customer service; 43. The Organizer will inform you about changes to the Regulations via a notice on the website www.zagrywki.pl.
44. Changes to the Regulations will be effective no sooner than 7 days after we inform you about such changes.
45. Changes to the Regulations will not affect orders already placed if you place them before the changes take effect – in such a case, we will process them under the existing terms and conditions.
Personal Data
46. The personal data controller is Gravity Park sp. z o. o. with its registered office in Warsaw at ul. Goplańska 35, 02-954 Warsaw, tel. +48 22 123 55 66, registered in the Register of Entrepreneurs of the National Court Register under number 0000514593, entered in the REGON register under number 147296989, Tax Identification Number (NIP) 9512380720, with share capital of PLN 5,000.00. 47. Personal data are processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation – hereinafter referred to as the "GDPR").
48. Personal data are processed for the purposes of:
a – performing a contract or taking steps at the request of the data subject prior to entering into a contract (legal basis: Art. 6, paragraph 1, point b of the GDPR),
b – handling inquiries related to the provision of services (Art. 6, paragraph 1, point f of the GDPR),
c – handling complaints and grievances (Art. 6, paragraph 1, point b of the GDPR),
d – maintaining documentation for the purpose of establishing, pursuing, or settling claims (Art. 6, paragraph 1, point f of the GDPR).
49. Providing data is voluntary, although necessary to use the service.
50. The required data includes: first and last name, email address, and telephone number. This data is processed for the purpose of personal identification or subsequent verification.
51. The Controller does not transfer, sell, or lend the collected data. Only authorized employees or associates of the Controller providing services related to the process of accepting or archiving declarations may be recipients of the data.
52. Personal data is processed for the period required to establish, pursue, or defend legal claims. Detailed information can be found in the Privacy Policy.
53. With respect to accounts created during the booking process, personal data is processed until the account is deleted. After account deletion, the Organizer has the right to process only the data necessary to establish, pursue, or defend legal claims, or where data retention is required due to tax regulations.
54. Every data subject has the right to access, rectify, erase, or restrict their personal data, including the right to object to processing, as well as the right to data portability and to lodge a complaint with a supervisory authority.
Token Activities
55. Tokens can be purchased at Zagrywki. These tokens are a contractual means of payment and are used in activities whose outcome depends solely on skill. One token is worth PLN 6. The token has no validity limit.
56. Token activities are not a game of chance, a game of chance, a mutual betting game, or any other gambling game within the meaning of the Gambling Act of 19 November 2009. The Organizer reserves the right to exclude token activities from use at any time (e.g., due to a malfunction, exclusive reservation of a given level, etc.).
57. Purchased tokens are not redeemable for cash in whole or in part under any circumstances, are non-refundable, and are not exchangeable for other products offered by Zagrywki. Subject to Section 56 of these Terms and Conditions, tokens are not a means of payment and cannot be used to make purchases at Zagrywki or anywhere else.
Terms and Conditions of the "ZAGRYWKI BAR" Prepaid Card
effective from July 8, 2025
Definitions
Data Controller / Issuer – Gravity Park Sp. z o. o., with its registered office in Warsaw at ul. Goplańska 35, 02-954 Warsaw, phone no. 22 123 55 66, registered in the National Court Register in the Register of Entrepreneurs under number 0000514593, entered in the REGON register under number 147296989, and Tax Identification Number (NIP) 9512380720. Card – an electronic goods voucher issued to the bearer in the form of a physical card, which entitles the card to be used in accordance with the terms and conditions set out in the Terms and Conditions. Customer – a natural person who is a consumer within the meaning of the law, or a natural person conducting business activity on their own behalf, or a natural person representing a legal person or an organizational unit without legal personality, which is legally capable of concluding a contract.
Third Party – a natural person, legal person, or an organizational unit without legal personality within the meaning of the provisions of Polish law, other than the Customer and the Publisher.

How can I purchase a Card?
1. The Card can be purchased in three ways:
– By making a seat reservation via the Website or by email,
– By purchasing the Card via email or in-store at Zagrywki,
– By receiving it as a "gift" from the Issuer.
2. If the Customer makes a reservation on the Website, they must meet technical requirements, such as having a device with internet access.
3. When making a seat reservation, the Customer will receive a card for the amount paid. When paying by Card, the amount paid will be reduced by 10% of the order value, regardless of where the order was placed. The Card can be collected at Zagrywki on the day of the reservation.
4. When purchasing a card via email for a reservation for a group of 8 or more people, the Customer will receive a card for the amount paid. When paying by card, the amount paid will be reduced by 10% of the order value, regardless of where the order was placed. The card will be available for collection at Zagrywki on a previously agreed-upon date.
5. When purchasing a card at Zagrywki or by email for reservations for groups of less than 8 people, the Customer will receive a card for the amount paid after payment. If the Customer wishes to use the service, the amount paid will be reduced by 10% of the order value. Cards purchased in-store can be used immediately.
6. If the Customer receives a card as a "gift" from the Issuer, detailed rules for collection, use, and points value will be specified in a separate agreement.
7. Seat reservations and reservations made by email for groups of more than 8 people, during the reservation period, are subject to a mandatory service fee of 10% of the order value, regardless of where the order was placed.
How can the card be used?
1. The card is active upon collection at Zagrywki. 2. The Card can only be redeemed for goods available at the bar, at Zagrywki, within the Card's validity period.
3. The Card's face value is converted into 1 point: PLN 1.
4. The first and last name or company name assigned to the Card must be provided to the seller.
5. When redeeming the Card, in connection with the purchase of goods, the face value of the Card will be reduced by the price payable to the Issuer for the goods sold and the service fee, if applicable.
6. If the value of the goods exceeds the value of the points on the Card, the Customer is obligated to pay the change in cash or by payment card.
7. The Customer is not entitled to receive change in cash or on a payment card if the value of the goods received upon purchase is lower than the current face value of the Card.
8. If the Card remains unused despite its expiration date, the Customer is not entitled to a refund from the Issuer. The Customer is obligated to collect the Card and use it. 9. Cards cannot be used to pay for activities at Zagrywki or for lodge reservations. 10. The Issuer will refuse to redeem the Card if:
a) the validity period has expired,
b) the Card has already been used,
c) the Issuer's staff (seller/host) raises doubts as to whether the person using the Card is authorized to do so (e.g., they don't know the name and surname or the name of the company to which the Card is assigned). The Card is assigned a reservation location and time (this information is not visible on the Card), and if the Seller has any doubts as to whether the authorized person is using the Card,
they may ask for this information,
d) the Issuer's staff (seller/host) raises doubts as to whether the person using the Card is authorized to sell alcohol. 11. The Card:
a) is not redeemable for cash, in whole or in part,
b) is not an electronic payment instrument, an electronic money instrument, or a payment card as defined by law,
c) has a nominal value (points to be used for purchases in accordance with the Terms and Conditions), but this value cannot be exchanged for any cash,
d) is an electronic gift voucher. A transaction made using the Card will also constitute a valid transaction if a third party uses the Customer's Card but knows the bearer's details (it is then assumed that the Customer has entrusted the Card to such third party for use).
How long is the Card valid and how can it be topped up?
1. The Card is valid for 1 year from the date of receipt and cannot be used after its expiry date.
2. The Card can be topped up to extend its validity.
3. Top-ups can be made at Zagrywki.
4. The minimum top-up amount is PLN 50. 5. The number of points corresponding to the face value of the Card is the difference between the top-up value (e.g., PLN 50) and the 5 points collected for the service, i.e., delivering the products to the table (50 – 5 = 45).
6. A Card issued for a reservation for an organized group of 8 people who made an email reservation and/or for a seating reservation, is topped up to the same Card during the reservation period. The Customer will receive a top-up to the Card for the amount paid. When paying with a top-up Card, the amount paid will be reduced by 10% of the order value, regardless of where the order was placed.
7. Cards purchased at Zagrywki, or by email for reservations for groups of less than 8 people, must be topped up to the same Card. After payment, the Customer will receive a top-up equal to the amount paid. If the Customer wishes to use the service, the amount paid will be reduced by 10% of the order value.
8. The Organizer reserves the right to issue a new Card if the Customer wishes to top up funds on the Card issued for a reservation for an organized group of 8 or more people who made an email reservation and/or for a seat reservation, if the Customer wishes to top up the Card after the reservation is completed. After payment, the Customer will receive a Card equal to the amount paid. If the Customer wishes to use the service, the amount paid will be reduced by 10% of the order value.
How do we process your personal data?
1. Personal data is processed in accordance with the Zagrywki Privacy Policy, available on the Website. 2. The Issuer may send notifications to the email address provided by the Customer, informing them of: Card collection reminders, approaching Card expiration, Card top-ups, etc.
Complaints
1. Please submit complaints electronically to the email address [email protected]
2. In your complaint, please provide as detailed a description of the irregularity as possible (including, for example, the time and place of occurrence and any indication of how the complaint will be resolved).
3. Complaints will be reviewed as soon as possible, but no later than 14 days.
4. The date of filing a complaint is the date the complaint is received by the Issuer. Rights and Obligations
1. The Customer has the right to:
a) use the Card in accordance with the Terms and Conditions,
b) submit inquiries to the Issuer's customer service regarding the use of the Card and/or file complaints,
2. The Customer undertakes to:
a) use the data and/or personal data for which they have full rights,
b) verify whether they meet the requirements for using the Card,
c) not use the Card in a manner that violates the law, the provisions of the Terms and Conditions, or the principles of social coexistence. It is prohibited to use the Card for terrorist, sabotage, or other criminal activities, or to violate any law or commit torts.
d) not to take any actions that are inconsistent with generally applicable law or good practice, or that infringe upon the personal rights of other persons (including legal entities) or the legitimate interests of the Issuer or other persons (including legal entities).
e) not to gain access to the Cards of other persons.
f) not to interfere with the Card infrastructure, including its content, not to breach security measures, not to duplicate them.
g) not to introduce them into circulation.
h) not to ensure the security of the Cards and not to entrust them to third parties.
3. The Issuer undertakes to make every effort to ensure the proper provision of services on a continuous and uninterrupted basis. However, the Issuer reserves the right to temporarily unavailable Card fulfillment due to force majeure. The Issuer will make every effort to minimize the inconvenience to the Customer due to this unavailability.
Final Provisions
1. The Issuer reserves the right to amend the Terms and Conditions. Each document is marked with the date from which its provisions apply.
2. In the event of a change to the Terms and Conditions during order fulfillment, the provisions in force on the date of commencement of order fulfillment shall apply.
3. In matters not regulated by the Terms and Conditions, the relevant provisions of Polish law and/or the provisions of consumer law applicable in the place of residence or the terms of the contract concluded between the parties shall apply.
4. In the event of a change and/or invalidation of any provision of the Terms and Conditions by a final court decision, the remaining provisions shall remain in force. 5. The Publisher declares its willingness to resolve disputes amicably, including out-of-court ADR (Alternative Dispute Resolution) claims. In such cases, please submit complaints via the website:
