General provisions
1.1. These Terms and Conditions (hereinafter: Terms and Conditions) set out the rules of operation and conditions of participation in the bonus sale entitled “Hit and Win” (hereinafter Bonus Sale) concerning the Products specified below in the Terms and Conditions.
1.2. The Organiser of the Bonus Sale is Gravity Park sp. z o.o. with its registered office in Warsaw at ul. Goplańska 35, 02-954 Warsaw, tel. 22 299 54 59, entered in the Register of Entrepreneurs of the National Court Register kept by the District Court for the Capital City of Warsaw, 13th Commercial Division of the National Court Register, under No. 0000514593, entered in the REGON register under No. 147296989, with NIP No. 9512380720; with share capital of PLN 5,000.00 (hereinafter referred to as the Organiser).
1.3. The Organiser is the sponsor of the prizes awarded as part of the Bonus Sale.
1.4. The Bonus Sale is organised in the Republic of Poland and is conducted on-site at Zagrywki, ul. Nowy Świat 4a, 00-497 in Warsaw (hereinafter referred to as Zagrywki).
1.6. The Bonus Sale is valid during the “Hit and Win” events (hereinafter referred to as the Event), according to the rules set out in the Terms and Conditions.
1.7. The Bonus Sale will be conducted inside the Premises and, therefore, pursuant to Article 131(9) of the Act of October 26, 1982, on upbringing in sobriety and counteracting alcoholism, it is not subject to the ban on advertising and promoting alcoholic beverages.
1.8. By participating in the Bonus Sale, the Participant accepts the regulations regarding participation set out in these Terms and Conditions.
1.9. As part of the Bonus Sale, participants purchase the Bacardi-based drinks listed below, for which the buyer receives a token entitling them to participate in a dedicated Activity at a given Event on the terms described in the Terms and Conditions.

- Martini Vibrante & Tonic
- Martini Floreale & Tonic
1.10. The purpose of the Bonus Sale is to reward Participants who have met the conditions described in the Terms and Conditions
1.11. The Organiser shall have exclusive copyright and intellectual property rights to the Bonus Sale, its promotion and name, as well as exclusive copyright and intellectual property rights to the prepared text and graphic materials related to the Events.
2. Participants and rules for participating in the Bonus Sale
2.1. Participation in the Bonus Sale is voluntary and free of charge.
2.2. The Bonus Sale is addressed exclusively to adult natural persons who do not conduct business activity and who purchase Products (hereinafter collectively referred to as: Participants, or individually as: Participant).
2.3. The Bonus Sale is not a game of chance, raffle, mutual bet, promotional lottery or any other game whose outcome depends on chance.
2.4. Persons interested in participating in the Bonus Sale should read the Terms and Conditions, made available by the Organiser at the Premises and on the website https://zagrywki.pl/warszawa/regulamin-akcji-traf-i-wygraj, before participating.
2.5. Participation in the Bonus Sale is tantamount to acceptance of the provisions of the Terms and Conditions and entails the obligation to comply with the rules they contain..
2.6. Participants in the Bonus Sale undertake to:
a) keep confidential all data and information to which they have gained access to in connection with their participation in the Bonus Sale;
b) refrain from any actions that could potentially harm the interests and/or reputation of the Organiser;
c) perform tasks related to participation in the Bonus Sale honestly, in accordance with generally applicable laws and rules of social coexistence, including in particular in a manner that does not violate the Organiser's rights;
d) provide only true information about the circumstances entitling them to receive prizes as part of their participation in the Bonus Sale;
e) refrain from taking any action that could be construed as unfair competition.
2.7. The Participant shall be solely responsible for the actions taken by them to fulfil the objectives of the Bonus Sale.
2.8. The Participant is entitled to take part in the Bonus Sale after meeting the following conditions:
a) for purchasing a selected Product during the Bonus Sale Period, the Participant is entitled to receive a dedicated Token (hereinafter referred to as the Token), which is available and valid only during the Events. The Token entitles the Participant to participate in the Activity available at a given Event, the outcome of which depends solely on skill. The Token is not a means of payment and cannot be exchanged for cash.
b) After handing over the Token to the person operating the Activity, the Participant takes part in the Activity available during a given Event and, after achieving the goal specified for a given Activity, receives a prize.
2.9. Participants are entitled to multiple attempts to obtain a Prize as part of the Bonus Sale during a given Event for each time they meet the conditions specified in point 2.8. However, no Participant is entitled to obtain more Prizes than the maximum number of Prizes specified in point 3.2 below, to which a single participant is entitled.
2.10. The activities referred to in point 2.8 are dedicated activities (hereinafter referred to as Activities) whose outcome depends on skill, available in Zagrywki exclusively to Participants in the time of the duration of ‘Hit and Win’. The Activities are not a game of chance, a gambling, a mutual bet or any other game of gambling within the meaning of the Act of 19 November 2009 on gambling.
3. Activities and Conditions for obtaining prizes
3.1. During each Event, one of the Activities listed below is available, and the Participant is entitled to receive a Prize according to the rules specified for each Activity.
a) Bacardi Button -> Rules: The Participant has one chance to stop the clock at a specified time during a given Event, e.g. 00:10:00. Upon achieving the goal, the Participant is entitled to receive a Prize worth PLN 100.
b) Bacardi Crazy Golf -> Rules: The Participant has one chance to hit the ball into a specially made golf hole. After hitting the hole, the Participant is entitled to receive a Prize worth PLN 100.
c) Bacardi Beer Pong –> Rules: The participant has one chance (one ball) to place a ball into a designated red cup, which is placed on the table among 9 other similar cups. After placing the ball in the correct cup, the participant is entitled to receive a prize worth PLN 100.
d) Bacardi Crazy Darts -> Rules: Participants have one dart to use. The throw is made from the appropriate distance. After throwing and hitting the appropriately marked field, the participant is entitled to receive a prize worth PLN 100.
e) Bacardi Cans -> Rules: The participant has one attempt (one throw with a bag) to knock all the red cans off the table. After making the throw and knocking all the red cans off the table, the participant is entitled to receive a prize worth PLN 100.
f) Bacardi Skeeball -> Rules: The participant has one attempt (one ball) to place the ball in the “target”’ by rolling it along the designated track. After placing the ball in the “target”, the participant is entitled to receive a prize worth PLN 100.
g) Bacardi Ringo -> Rules: The participant has three attempts (3 throws with a ring) to place the ring on the neck of the bottle. After placing at least one ring on the neck of the bottle, the participant is entitled to receive a prize worth PLN 100.
3.2 The maximum number of Prizes for a single Participant at a given Event is two. No Participant is entitled to receive more than two Prizes during a given Event.
3.3. The Prizes referred to in the Terms and Conditions are cash prizes available to Participants in the Bonus Sale during a given Event, the amount of which for a single Participant depends on the goal achieved in the Activity, but not more than twice the amount of a single Prize at a given Event and/or the total pool of Prizes available during a given Event, i.e. PLN 2,000 (in words: two thousand zlotys).
3.4. None of the Participants taking part in the Bonus Sale is entitled to receive prizes with a total value exceeding PLN 2,000 (in words: two thousand Polish zlotys).
3.5. Prizes are issued by the Organiser directly at Zagrywki after the conditions for obtaining prizes referred to in point 3.1(a), (b), (c), (d), (e), (f) or (g) of the Rules have been met, and are issued until the end of the Event or until the prize pool specified in point 3.3 has been exhausted.
3.6. If the prize is not collected for reasons attributable to the Participant, the prize shall be forfeited to the Organiser.
3.7. The right to the prize cannot be transferred to another Participant or any other third party. The Participant is not entitled to receive any other form of equivalent for the prizes specified in the Terms and Conditions.
3.8. If the Participant obtains the right to a prize in violation of these Terms and Conditions, the law or good manners, the Organiser may decide that the Participant forfeits the right to receive the prize in full, and demand that the Participant return the prize received in full.
3.9. The Organiser reserves the right to change or add new Activities, the value of prizes and the rules for obtaining them. The Participant will be informed about the rules and Regulations before the start of the Event.
Liability
4.1. The Organiser shall exercise due diligence to ensure the proper operation of the Bonus Sale.
4.2. The Organiser shall not be liable for the inability to collect the prize for reasons attributable to the Participant.
4.3. The Organiser shall not be liable for any incorrect actions taken by the Participant as part of the Bonus Sale.
4.4. A Participant who acts to the detriment of the Organiser, including in particular providing false information as the basis for claiming the prize, may be excluded from further participation in the Bonus Sale and deprived of the right to the prize.
4.5. A Participant who has failed to meet the conditions for obtaining the prizes referred to in point 3.1(a), (b), (c), (d), (e), (f) or (g) of the Terms and Conditions within the time limit specified in point 1.6 of the Terms and Conditions shall not be entitled to any claims against the Organiser.
Taxation
5.1 Prizes awarded as part of the Bonus Sale are exempt from personal income tax pursuant to Article 21(1)(68) of the Personal Income Tax Act of 26 July 1991.

6.1. Participants are provided with contact details for the Bonus Sale coordinator appointed by the Organiser for each Event.

Complaints
7.1. Participants may submit complaints regarding the manner in which the Bonus Sale is conducted by email to [email protected]. In order to streamline the complaint process, the Organiser recommends that complaints be marked with the note ‘Complaint – Hit and Win’.
7.2. When submitting a complaint, the Organiser asks for the Participant's contact details to enable feedback and consideration of the complaint, in particular: the Participant's first name, surname, postal address, e-mail address, and a description and reason for the complaint. At the request of the Participant submitting the complaint, expressed in its content, the Organiser shall issue a confirmation of its submission. Depending on the instructions provided, such confirmation shall be delivered at the Premises, in writing or by electronic means of communication.
7.3. Complaints will be considered by the Organiser within 14 days of receiving them..
7.4. The Organiser will consider Participants' complaints on the basis of the Terms and Conditions and generally applicable law.
7.5. Participants will be notified of the outcome of the complaint by email to the email address from which the complaint was submitted.
7.6. For the avoidance of doubt, the provisions of this section 7 do not affect the rights of Participants under generally applicable law.
Personal data
8.1.The Administrator of the personal data of Participants entitled to receive the Prize or submitting a complaint is Gravity Park sp. z o.o. with its registered office in Warsaw at ul. Goplańska 35, 02-954 Warsaw, tel. 22 299 54 59, entered in the Register of Entrepreneurs of the National Court Register kept by the District Court for the Capital City of Warsaw, 13th Commercial Division of the National Court Register, under number 0000514593, entered in the REGON register under No. 147296989, with NIP No. 9512380720; with share capital in the amount of PLN 5,000.00.
8.2.The Administrator processes the following personal data of Participants, provided voluntarily: name and surname, e-mail address and other data contained in the prize collection report or in the Participant's complaint.
8.3.Providing personal data is voluntary, but necessary in order for the Participant to collect the prize or submit a complaint and for the Organiser to consider it.
8.4. Personal data will be processed by the Administrator in accordance with the Regulations and generally applicable regulations for the purpose of:
a) Verifying compliance with the conditions set out in these Regulations and performing the contract to which the Participant is a party – pursuant to Article 6(1)(b) of the GDPR;
b) considering complaints and communicating with the Participant – pursuant to Article 6(1)(f) of the GDPR, i.e. the legitimate interest of the Administrator;
c) pursuing or securing claims – pursuant to Article 6(1)(f) of the GDPR, i.e. the legitimate interest of the Administrator.
8.5. Personal data processed for the purpose of verifying the fulfilment of the conditions for obtaining a reward or complaint will be processed by the Administrator for the period of limitation of claims under the law.
8.6.The recipients of the Participant's personal data may include: external service providers (e.g. entities providing IT, postal services, etc.), as well as accountants and auditors, couriers, lawyers, administrative authorities and courts. Participants' personal data will not be transferred to third countries or international organisations, nor will it be subject to profiling.

8.7.The Participant has the right to request the Organiser to access their personal data, rectify it, delete it or restrict its processing, transfer it, or object to its processing. The Participant has the right to lodge a complaint with the supervisory authority – the President of the Personal Data Protection Office.

Final provisions
9.1. In matters not covered by these Terms and Conditions, the provisions of the Civil Code and other relevant provisions of Polish law shall apply.
9.2. The Organiser reserves the right to amend these Terms and Conditions at any time, provided that this does not adversely affect the rules of participation in the Bonus Sale for Participants who registered before the date of amendment of the Terms and Conditions, in particular, the amendment to the Terms and Conditions may not adversely affect the results obtained by the Participant entitling them to a prize and shall not infringe the rights acquired by the Participants under the existing Terms and Conditions. Information about the amendment to the Terms and Conditions will be announced before the Event to which the Terms and Conditions apply by posting the Terms and Conditions on the Organiser's website and at the Premises, but no later than 14 days before the amended Terms and Conditions come into force.
